Hello friends,
I have a few questions.
(1) I have an H1B stamp valid till SEP 2009. It was stamped this way because my passport earlier had a validity only of upto SEPT 2009 although my petition I797 has an end date of upto Feb 2011. I have now renewed my passport. I am going to travel to India on May 2009. Will I be able to get a re-stamp in India till my valid I797 duration which is till Feb 2011. This is confusing because, some forums threads say that US consulate will revalidate the visa only if there is 60 days ot lessremaining on the H1B. When I go to India in May, I will have more than 60 days. I am not sure if I should fix a visa interview and try for a re-stamp. I thought I could get it stamped when I am visiting India for my marriage, but I wonder if I am too early. I am not getting any conclusive information on this.
2) Is revalidation the same as Visa restamping ?
3) On previous occasions on re-entering usa, my I-94 was always stamped with a date of OCT 2009 (when my passport was valid till Sept 2009, and VISA stamp is also valid till SEPT 2009 although I-797 is till Feb 2011). My fear is when I travel back from India and re-enter U.S, will my I94 again be stamped only till OCt 2009 or will it be stamped till the valid I797 date which is Feb 2011 ?
4) After my marriage, my spouse plans will be going for Visa interview. If my VISA stamp is only till Sep 2009 but my I797 is valid till feb 2011, will her H4 get stamped till SEP 2009 (my H1b visa expiry date) or will her H4 be stamped till FEB 2011 (My I797 validity date)
Thanks, Vivek
