There are two close questions in my RFE request. I am not sure how to argue them.
a) submit evidence to demonstrate that the national interest would be adversely affected if the petitioner's current employer were to take the time to obtain a labor certification for the alien.
b) You must persuasively demonstrate that the national interest would be adversely affected if a labor certification were required. You must demonstrate that it would be contrary to the national interest to potentially deprive the prospective employer of the beneficiary's services by making available to U.S. workers the position sought by the beneficiary.
I am confused because these two points are so similar. I plan to argue against LC by saying my exceptional abilities make me the most suitable person for the job. Loss of my contributions will significantly delay the progress of the important field. LC can not ariticulate my exceptional abilities and will replace me with a minimally qualified American worker, therefore it is harmful to national interests.
Fist, I would like to know your opinions on my arguments. Second, can I use the same arguments for both the (a) and (b) points? Are they slightly different? If so, how to argue them differently?
