Finding #1: Salary

My salary was $60,000 when I applied LC. The OES was $71,427 in 2001. My current salary is $68,800 (more than 95% of $71,427) and OES is $78,000. Will this be a big problem?



Finding #1: Approve that all applicants are contacted

All applicants was contacted and some are asked to have an interview. However, one applicant never answered the phone calls and one applicant scheduled an interview but never showed up. NOF mentioned that contacting applicants only over telephone is not enough. Is there a solution for this?

hi,

i have similar case. In my case, they have picked only one applicant and said we have not interviewed him. In fact the employer did interviewed him over phone. loyer has replyed the rebuttal. waiting for the decesion.

In yr case did they picked up some name from applicants or in general did they made the statment ? share some more information.

if your company is in sound financial standing, and when I-140 gets filed in, and company can show that the salary mentioned in LC is payable after the GC is approved, I don't see any problem.

DOL picked two names: one is called for couple times but never replied, the other one is scheduled but never show up.
