I need your help in exploring some options although sent an email to my lawyer as well and hopefully by tomorrow morning will get some answers.
I had a family urgency in India and for that my family (my wife and my son) needs to travel to India and my current status is:
I-1485/I-765/I-131 (AP) all three have been applied in June 2007. I have got the receipt notices as well for all of them.
My I-140 is also approved.
My current H1B/H4 (8th year extension) expires on May 2008 but unfortunately we don't have the VISA stamped in our passport?
Now what are my options
a) Can I get interim AP on this emergency basis form USCIS?
b) Can my wife and my son travel alone and get the VISA stamped based on approved H1B/H4 (approved petition) form Delhi Consulate?
c) They can travlel and in the mean time I can try getting AP asap?
Since for some work related reason I can't travel right now so not sure in that case option(b) is possible i.e. going to Delhi consulate for VISA stamping w/o me.
Appreciate your immediate attention and guidance in this regard.
