Hello Gurus,

I am currently working in NJ, my immigration status is given below:


1) I-485 applied for more than a year (VSC)

2) I-140 approved 2 years ago

2) Have a valid H1-B expiration date November 2005

3) Have a valid EAD (1st extension) until 2005

4) Have never used my EAD before

I got married last december and my wife is on an H4 Visa, her GC is not yet filed.

I would like to move to the Boston area on a new job using my EAD and AC-21. If I file my wifes i-485 before I change my jobs am I OK with respect to her status? I basically want to make sure that her status is not in jeopardy due to my job change what is the best way to achieve this ? At what point will she be off the H4 status i.e. as soon as I file for her i-485 or something else ?

Hi,
You can file I485 for your wife before Or after your job change, Since She is going to be Dependent. Are you going to give your
Boston address on i 485(Not talking abt AR 11). OR you can give NJ friend's address.

IF you file i485 for your wife, it is not going to affect her H4
Status. She will still have AOS/H4 status.

Just file your wife I-485 before you start using EAD. Once you use EAD she automatically loose her H4 status. If I-485 is not filed before that she will not have any status, which can create problem later.
You address change does not matter. But it is not safe to change the address when EAD/AP is pending as they will go to old address.

I did not notice your Job change. In that case you will loose your Current h1B Status/Spouse H4 Status, since you are joining New company.
