help needed, urgent!!!!!!

Dear all,

My atttorney who handled the filing of I140 does not give me the approval notice and original I-140 application documents. I have paid him about $4200 in total ($3300 initial attorney fee+ $400 mailing and copy fee + $500 inquiry fee).

Now hw want me to pay him another $1500 for the cosular processing. But I have told him that I want to handle the Consular Processig by myself or other attorney. He then refuses to give my the approval notice and the original I-140 application materials. What can I do to solve this problem?

by the way I did not have any written contract with him from the very beginning.

Please help.

The service center would have send out a courtsey copy to ur employer

Get that copy of I-140 from ur employer and proceed further ,try to maintain good relationship with ur attorney too..
You never know when u might need some documents from him

Don\'t rush, choose yr path

You don\'t have a legal case. negotiate better.

In favour of lawyer-
There is not much you can do- biggest mistake is no contract from beginning. He is not bound, you are bound to him because of being in begging situation for impending-GC.

Since you have already paid hefty sum, what is more important to you- 1500$ or peace of mind & time? Whatever you choose- decision is your\'s.

In favour of yourself-
Are you taking receipts from him for money paid?
Call lawyer becoming an udentified man and find out total fees, including CP. Try to record the voice and then display the facts.
He cannot run his law firm, just based upon your money. He would loose clients, if his clients defame him. He is ultimately a business man, who was to worry abt his fame/de-fame. So discuss with him, very politely (if you fight, you would loose this negotiation battle) that both of you have a need, so both should be able to bring something to table in deadlock. (Remember- in negotiations, don\'t put your demand right forth- if you demand, you would loose). Give him some time and then call, ask him if he had thought abt it. If he gives you time, that means he is interested in negotiating. Go from there.
