Help Needed - Separation after filing joint I-751

I stumbled across this forum by accident and thought that I would give it a try since it seems that many of you have gone through situations similar to mine. I have been married to my husband for two and a half years and have tried everything in our hands to make it work except for marital counseling. About two months ago he left our home and I started attending a psychotherapy because I could no longer take the pressure. Prior to leaving our home, he signed the I-751 application.

I went to see the lawyer that had processed my papers to obtained the conditional residency two years ago and he informed me that the only way to ensure that I would obtain my papers was to keep the ball rolling and ask him for the possibility to come to an arrangement. Needless to say, he did not want to help me out unless I gave him and our marriage another chance. I mailed my I-751 on May 19th and received the 1st NOA on 05/29. He has come back home and I feel like the situation is unbearable and not fair for either one of us. I wish I would have found this forum prior to filing because I would have requested a waiver and skipped filing jointly. Is the anything that I can do at this point? Can I send a letter to the USCIS explaining that we have decided to separate? Or can I get away with not informing them and having him remove his name from our lease and close our joint bank account?

I live in Virginia and our law states that you must be separated for 6 months prior to getting a divorce, however; he wants to file a legal separation through a lawyer which makes no sense because we do not own any property together or have any children.

Please, please help....

You would have to file a new I-751 with the fees again. I assume you sent your application to the Vermont Service Center?(VSC) which is moving pretty damn fast approving 751's now. Your best bet is to try to wait it out for a few more months with him. They are approving March 09 applications now!

Give the marriage a few more months if you can, best bet!:)
