Help Needed Regarding receipt Notices !

Hi Gurus,
As per my attorney, they sent I40/485 application to TCS Center on 8/24/2004 and still waiting for Receipts notices. Employer called up attorney office and got response that I should wait 8 weeks. That does not seem reasonable. Any body out there with similar situation, please respond. Attorney refused to check whether checks has been cashed or not. I'm in urgent need of travel document. Any advice will be apprciated.

Some time yes!

I waited for 5 weeks. So better wait for some more time. It will evantually come.Good luck, and take it easy.

Typical wait (in CSC and NSC) is only like 3 weeks for most folks.
Am not sure if this 8 wk deal is a TSC thing or not ....

Hopefully the attorneys have really sent the stuff .... so atleast your processing times would not be affected
 
Absolutely the sam here. I also filed exactly on 8/24/04 but at Vermont. I also still haven't recieved the receipt. I sent money orders, and not personal checks, but I was able to check that they have been cashed on the 31st of August. I still don't have the receipt number, but at least know it went through.
Tomorrow is going to be 30 days since we filed, so we can call 1800 375 5283 and since we are the applicants, and not dependents, we can ask for the receipt number and status. Also, if you sent personal checks, you don't need to ask your lawyers to check on the status, you can see that for yourself at your bank.

I hope we get more information soon.

2nd thing, you mentioned that we can call 800-375-5283. How do we get our receipt numbers/ status without any reference? Can they check by our last name/First name and SSN ? What information, they will ask and do search to give us receipt numbers.

No -- AFAIK, the 800 number will only search on your case number ... they can't do a search on name, SSN etc etc ...

Your best bet is to push the attorney to get the number -- after all he is YOUR attorney working on YOUR case.
In one of my friends' case, the attorney was stalling in a similar way and she found out that her paperwork had not been even filed yet. Needless to say, she changed the attorney the same day :)

He is not listening to me. He said don't call him before 8 weeks. After 8 weeks, then check with us. I don't know what to do as he is holding all information.
I'd wait 3 more weeks and hope for the best.
I had same suspisious that he did not file but I don't know what to do other than beleive him that he sent my application and hoping to get my receipts in couple of days....
1 more thing, how does your friend find out that he is not telling truth and he did not file.....
Any advice will be appriciated.

I think there is hope. I filed also on 24th of August, and I have just recieved not only the reciept number but also the EAD itself. I know your case is a little different and you are on I-485 process already, but I hope this gives hope, that they do act quite fast.

How did you hear about that? Did INS send you receipt directly OR they sent to attorney office? Also how about EAD? Did they sent directly to your home address or attorney office?

Sorry to hear about your attorney.

With regard to my friend, basically she kept pushing the attorney for receipt num information over and over .... and finally he said he hasn't filed and gave some lame a$$ excuse for that.

I don't think you can really find out without the attorney admitting it.

Is this your own attorney or is it someone paid for by ur company ??
 
Kalse 2000, I filed myself, so I got everything right to my home address. EAD card right in my mail box.
If your lawyers did send the applications (lets hope so) they must be able to see the receipt number on the cashed check. Just being lazy. I had lawyers who handled my H1B before, but when it got to green card process, just paid a whole lot of money (and I mean a lot), and there were no results. So I just sent them to hell and did everything myself.
About that 1800 number for calling. I filed on 24th of August, so 30 days have not passed yet and I do know know to what extent they can help. But when I called they asked me when did I file, to what center, what forms did I file, then asked if I tried to check on the money orders (checks in your case), and then they told me it wasn't 30 days yet, so they cannot give me more information. From that I information I imagine they would be able to tell the receipt number, and if not then at least to send it again and/or speed it up a little. All in all, it seems that your lawyers just do not want to do much work. Same happened to me.

Basically, they say (I send money orders so it is different) that whoever sent a personal check can see in their bank when was that particular check cashed and plus, INS puts a receipt number on that check clearance. So if one is able to access the account (and lawyers I imagine can see their own account- any person can see their account history), it is also possible to see the receipt number.

Yeah -- I guess in this case its not about how difficult or easy it is for the lawyer to get the information --- its about the fact that the lawyer is clearly not interested in trying to give/get the information.
I think these kind of attorneys kinda bring a bad name to the entire profession !
 
Got the reciept notice within a week

Here is my experience...

I have applied for my EAD renewal (yes TSC) myself during the end of 1st week of Sept and I got the reciept notice by mid of this month. I observed the check getting cleared on second day after they have recieved the package and I could see the reciept number on that.

I recieved the reciept numbers within two weeks when we applied the first time also, yeah it was thru lawyer..on 09/10/2003..I-140,485/765, FP done during Feb of 2004 and no progress after that...
 
This attorney is really giving me hard time. Is there any information on INS Web site, where I can tell attorney that receipts should be received with such dates....If not then contact to INS or something.... If I can get this then I can push him to look into his account and give me receipt no.
One more thing, he said that they sent application through Regular mail. Is this normal pratice for attornies ?

I'm paying for all this but what's happening is he send invoice to employer and employer pay invoice and then deduct from my salary.

Honestly all the attorneys that I've known send applications thru some kind of trackable service.
(USPS Express Mail / Priority Mail with return receipt ).
I don't think they use FedEx/UPS for PO Box addresses -- but some apps have an alternate address for these services - if so they use them.

I've not heard of them using regular mail.

The more I read of your attorney's behavior, the more suspicious I get.
At this time, you just have to wait .... am not sure with this "paid by employer/deducted from paycheck" logic, whether you are free to change attorneys. I don't think so.

Your I-485 and I-140 applications were returned by the INS to our office a couple of weeks ago for no apparent reason. Our office checked the package and everything was in order; nothing was missing, so we don't know what they overlooked. (We also had other cases returned as well, also for no apparent reason.)

Janet sent back the package to the INS the same day we received it, 9/15, so we should have the receipt notices soon.

We apologize for this inconvenience although it was out of our control."


Any advice or comments? what should I do

Did you sign an agreement with your attorney or your company did? It looks like the best option for you is to get a better lawyer. And I believe you are free to do that. His answer that USCIS returned your applocations without an "apparent reason" doesn't sound trustworthy especialy since they waited "couple of weeks" to inform you about it. I-140/I-485 process is a long one and you have to trust your lawyer that he/she reacts to the situation quickly and professionaly. Remember, your lawyer doesn't do charity for you - he works for money. And that is why he needs to do his job. There is no irreplaceable people!

By the way, my I-485 RD is 08/31/2004, VSC sent me a notice 09/07/2004 and my lawyer received it 09/14/2004.
