Help needed please

Here is my case.My dates for EAD renewal
Aug 23 RD
Aug 26 ND
and I still haven't heard anything from INS(VSC). My EAD is expiring next week OCt 22nd and I don't know what to do.If I get lucky my EAD can be approved within Oct 22nd.
My question is as my 485 is pending approval with INS and the dates for that are as follows
AUG 17-2001 RD
OCT 12-2001 ND
even though my EAD has expired am I leagally allowed to stay in US and go on leave of absence witht the company I am working again start working when I my EAD is approved.Any feednack appreciated.

If you are working on EAD, i.e. not on h1, then you cannot work until your EAD renewal is approved.
But since you are adjusting status, you are ok to stay in US until it's approved/denied

You have not privided one important information (which is till when your H1 is valid ) to this board to assist you to get some possible answers:

Here are the options:

1) Currently if you are working on H1 and which is valid till you get your EAD renewed, then you should be fine.

2) Currently your H1 is expired and if you are woking on EAD, then you should not work until your EAD is renewed.

To better answer your question, tell us till when your H1 is valid.

This is what my understanding, please take this with your own risk.

call VSC now to find out what is going on with your EAD and 485 ! You should have received both approvals long ago.

Thanks for the replies.Currently I am using EAD for my work.And my H1b is from a different company other than the current company I am working with.If I cannot work until I get EAD, can I stay in US or NO.And can I take leave of absence from my company till I get my EAD renewal approved.I called INS and IIO says all the info is officer and he has to make a descision god knows what that officer is doing and make people like us go thru all this pain.Any thoughts

You are still practically for all matters an Adjustee. Which means you can stay in this country until the INS makes a decision on your case and informs you thereof.

You cannot legally work until you get your EAD renewed. So your best bet is to take a leave of absence until your approved EAD comes in. OR you can trasfer you H1 to company you are working for now - if thats an option with the company.

I guess H1B is not an option as I had been working on EAD for about 9 months.I guess my best bet would be to take leave of absence.
