Help needed on OPT to H1B issue

Hi:
I am an MBA student currently on F1 visa. I have stayed in US on H1B for 3 years from 2003 thru 2006.

I got my current F1 visa from India where my previous H1B was cancelled without prejudice.

My Question:
When my employer files for my H1B again, do i fall under the H1B subject cap of 20000.

I think u do fall under the quota. You would be exempt if it was the same H1 being renewed.
