Hello every, I was introduced to this site by a friend and found it very resourceful. I do have a situation that I'm currently dealing with.
I just got married to someone who is an asylee( not a refugee) and according to the INS laws the asylee can request an asylee relative petiton for wife/husband or kid within the previous 2 years. On the I-730 page It said that if you were granted the asylee status more than 2 years , you are not eligible to file for the I-730.
My wife was granted this asylee status since the year 2001 and now she is getting ready to file or apply for her Green Card using the I-485.
I want to know if she can request the green card for me. My lawyer does not seem to give me a convincing answer for this case. The Ins web does not have anything clear relating to this specific situation.
Besides this situation I'm awaiting an immigration hearing in october.I was arrested on 9-12-2002 for violating my F-I visa..I Had the 20h/week working permit but I was working 28h/week, funny?
but It was real; I could not believe it myself. That I was put in jail for working more than 20 h. Since 2002 I haven't gotten a master hearing scheduled yet; they wanted to deport me and I did file for a asylum because of the political situation in my country and my implication in some political actions.
I Have a hearing in October but not a master hearing, which will probably come in another one year.
Will my wife's asylee status help my case? we're from the same country and she was giving the asylum for the same reason.
Please any help and suggestions will be welcomed.
