Dear Friends,
My case is a EB3 one ith PD of may 2002. I changed employer and missed to sent the AC21 letter. The previous employer applied for revoking my I140 in 2004. I received an intent to deny letter from INS due to I140 not in valid state. After I sent the AC21 letter, my case was transfered to Columbus,OH.
I had an interview at columbus in 2005. Due to visa number availablity issue the case is still pending.

Now for the last 2 week some weird things are happening in my cases.
1) My wife's I485 petion was transfered back from Columbus to Nebraska.
2) My I140 was reopened today.
With the following message

Current Status: Case reopened or reconsidered based on USCIS
determination, and the case is now pending.

We reopened this I140 IMMIGRANT PETITION FOR ALIEN WORKER on March 16,
2007, and are now reviewing our earlier decision. We also mailed you a
notice describing the next steps in the process. Please follow any
instructions on this notice. Our review should be completed within 30 days.
We will notify you by mail when we make a decision or if we need
something from you. If you move while this case is pending, call customer
service.

Thanks

:(

Following is the history of my case. Filed EB3 lc in may 2002. And applied for my i40 and i485 in Nov 2002 and May 2003 respectively. Changed the employer in May2004.

Hang in there

If you havent already done so, hire a top attorney to fight your case. You made a costly mistake. I am thinking your ex-employer revoked your 140 and sold the labor to someone else, so when they filed their 140, your application was bound to be denied due to the absence of AC21 letter. I really dont know the options left out for you, other than to speak to your ex-employer and work out a solution.

Rajiv will be hosting a conference call on Thursday March 22. I would suggest you can post your question in the Conference call thread and seek his advice. I think you should initiate a dialogue with your ex employer ASAP so some corrective action could be taken before any disaster. Good luck!

Thanks friends!!
At last I had a good news today. Today the application got approved again, not sure why they opened it on friday and (re)approved it on tuesday.
My wife's case got transfered back to Vermont..
Now it looks like Vermont-->local office--> Nebraska--> Vermont

I did file the AC21 when replying to the NOID letter.

Right now the storm looks to be subsided for the timebeing. In the meantime I've taken an infopass to verify at the local office on what is going on.

Once again, thank you all.

Regards!!

Need clear interpretation of this

My I-485 was denied on Jan 28th 2007 and I filed for MOTIC - Reconsideration to the commissioner, Nebraska office on Feb 16th 2007. We received a receipt on Feb 26th, 2007. I have been monitoring my case online and I recieved a notice in the mail for both self and spouse.
I-797 : After review , we have reopened the above application or petition, or reconsidered the decision previously issued. You will receive a notice under appropriate cover once all action has been completed.

Online, the case status says
"Current Status: Case reopened or reconsidered based on USCIS determination, and the case is now pending."

Does anyone know what this means

1] The case is being reopened but a decision on whether to deny or revert the status to pending (as it was before the denial) is still to be made.
2] The denial has been reversed and the case is back to pending till my PD becomes current.

Thanks in advance...

I am in the exact same situation:

1] The case is being reopened but a decision on whether to deny or revert the status to pending (as it was before the denial) is still to be made.
2] The denial has been reversed and the case is back to pending till my PD becomes current.

Does the message mean 1) or 2)
