Help needed! Family Based application, pref 4

Hello,
I am of Macedonian nationality and live in Macedonia.
My sister is a US citizen and we wanted her to file a I130 form for me.
We know that it will take an awfully long time, but we hope that it would be beneficial at least for my kids.

In the meantime my husband and I will be playing the green card lottery.

1. Since we will file I130, in case we get the lottery does the Embassy officer has the grounds for refusing our application?
2. In case my husband gets an H1B, can I come to the US on H4?

In case you win the Lottery you wouldn't need the I-130

I have no idea. Maybe you should ask this question in the appropriate forum.
 
If your Husband gets a H1B , you could get a H4 .
If you have a pending immigrant petition , You might have some problems during your Visa interview .

NO

H1 allows for dual intent. There should not be any problems with a pending I-130.

Yes . I agree . H1B has dual intent , and this should not cause a problem .

1. On what grounds would they reject it? Intent is the same, even though it
really has no bearing on the Lottery-based application.
2. Yes. I do not see any grounds generally for having problems with the I130
petition. The I130 is not yet a lodging of an immigrant visa application in
any event. H is also a dual intent visa.
