we are expecting a baby next year.we are thinking of delivering the baby in India.we are green card holders.Anybody has any legal advise on this one?.We are thinking to return 2 to3 months after the baby is born.

Have the baby be born here is the simplest solution - although the baby will not be a US Citizen by birth (one parent at the time of birth must be a US Citizen for the child to as well), she/he will be documented in the US - Having it in India complicated the situation, although I am not sure of it's implications.
 
I was wondering if we have to get passport and visa for the new born baby to get back to USA?.After coming here we can apply for green card for the baby.I have a 4 year old daughter who is born here.

Shreya, I am not too sure, but it would seem logical that either the new born baby is added onto your PP or your spouse's, or the baby gets his/her own pp. Definitely double check as there maybe a law out there that states children under a certain age get to travel w/o a pp.

Any child born in the United States is automatically a US Citizen. The nationality or immigration status of the parents is irrellevant. If you are born in the US, you are a citizen of the US.

Of course, I can't help but add a small addition: There is an exception: a person born in the US is not a US citizen if that person is born outside the jurisdiction of the US. This usually applies to children of diplomats.


Damn you're good! That's something that I bet 7 out of 10 immigration attorneys do not know. It is correct.
 
what i know is this...your child should be born here..
it would make him or her a citizen..
If not..and either of you are a citizen then, it does not matter where the child is born ..he or she automatical becomes a citizen...
if, i am wrong ..somone correct me! :rolleyes:
