I was working on H1 visa with employer A for 3 years and got laid off from that employer and now I am with new H1 with employer B. My green card was applied thru employer A and now my labor has been approved last week thru employer A.I am requesting employer A to sign I140 to enable me to continue with the current (B) employer for the next process. This is my last year of H1 visa which expires this year-end. In this regard I have few questions to clarify.
1.Employer A is refusing to sign I140.Understand I can’t transfer approved labor to employer B but incase if the employer A refuses to sign I140 will I be able to renew my new H1 (with approved labor of employer A) with employer B? and how long?
2.Will I be eligible for PERM process to apply GC with the employer B after March 2005?
3.Is there any way I can use employer A approved labor certification?
