Help me understand this new bill

I am planning to use a substitute labor with PD Aug 2003. Will the new bill coming do you think I should be able to file 485 if I use the Aug 2003 substitute labor.

It looks like everyone can file GC last step now.

Please help me understand.

Why are people so happy on this board?

What the pros and cons of this bill.
 
The pros of the bill are:

1. 90,000 visa recapture which will be given to emplyment based GC.
2. Dependents will not be counted againest the CAP.
4. Can file I-485 even during regression. But it will not be approved until the visas are available.

There are no Cons of this bill.

Now i am thinking of obtaining my own labor. Since there will be no waiting times, no priority date issues this is a cool move.

I just landed and was afraid since many people told that it will take 5 years for GC.

Now I am bit relieved.

So the dates will be current always right?
 
This is not yet law and have to clear one more hurdle. So, wait and see what happens in the next few weeks. I don't think the dates will be current even if it pass. The dates will definitely move couple of years forward. The good thing is you will be able to apply for I-485 even if your PD is not current and get EAD/AP.

Now It Looks Like It Is Easy

I Want To Settle Down Here
I Am Sure It Will Be Current As They Are Capturing 90000
That Is A Lot.

Can u please post the link to S 1932 where it says the points u wrote above ie recaturing 90k unused and dependents not countable under CAP etc.

labor_replace...its still a long way to go man...

but definitely u r better off...since u can get PERM in 3-5 months.....and then I-140 in 8-12 months....and then EAD in 4-5 months...

compared to all of us....some waiting since 2001.

but still i will not dream...till this bill becomes law.....have you seen the margin by which it passed the senate....52/47 (i may be off by few)

Please check with some one who knows the current discussions about substitution labor. I heard that they are going to bring some restricitons for this like scrutinizing the labor again even if you use substitution labor and will take your current date of using it as priority date and not the original date.
I am not sure about this. But check with attorneys before you use substitution labor.
 
converting from CP to I-485?

Hello GC_DJ and all,

Do you guys know if this bill becomes a law then can it help me.
I unfortunately opted for CP and now stuck with retrogression!!!If this bill comes law, can I opt for I-485 and get a EAD so that instead of waiting for the CP i can get a EAD and can work for another employer.

Does anyone know how many days it takes for a bill to become a law?...hopefully all of us would be hearing good news by end of this year or beginning of next year :)
