help me understand I-485 processing. Gurus please help!!

Hi all,

Is it sure that there will not be any problem later due to missing initial evidence once we get a receipt / A number? I read in I-485 form that once the file is receipted,initial evidence are checked during initial processing step and file can be rejected if initial evidences are missing. Does this means that even if we get a receipt number,there is a possibility that I-485 can be denied later during initial processing? Please help me understand the process.....My Attorney said that we will be fine once it is receipted. But the I-485 says something else. I am also scheduling a consultaion with MURTHY law firm to confirm this, as i am planning to refile I-485 (missed my birth certificates in previous application). Please someone reply.....
 
You are right , they look for initial evidence and if all the evidence are there but one or 2 say birth certificate or employment letter they might send you a RFE and then you can send those document back to them.
But sometimes they send you NOID ( Notice of Intent to Deny) if they find many evidence missing, but if you forgot to send the approved or pending petition for I140 they can deny the application but if you have got all the document you can always file a MTR and submitt all the document and they should approve your case.


But in order to avoid all these troubles and losing all this time its always a good idea to send all the required documents along with the application.

Just my 2 cents..

This is my observation that some times processing varies from case to case and person to person.. they have some procedures they follow but most of the times if you have your documentation right and all the evidence you should get pretty smooth approval. But some officers they look deep.

I am saying based on my personal experience as My application got denied
a2p bust 2 other colleagues of mine got approved based on the same tax returns and they were getting same wages as me and their preferred wages were also same as mine on Labor. But my application got denied.
