My 10 and 9 year old kids was being petitioned by my husband as step son and step daughter, but since my eldest is already 20 yrs old he wasn't able to petition him as his step son. So I will be the one who will petition him. Somebody help me please how will I start my petition to my son I don't have money to go to lawyer. And I don't my son to age out. You'll find that you as an LPR are eligible to file for your unmarried son of any age. He's going to be in preference category 2 and you guys have to wait until a visa number is available, which varies depending on preference category AND country of birth.

Once you follow those links, you'll also find all forms and fees necessary for your process.

is the oldest here legally? if not, doesn't he have to wait until she becomes a citizen?

I don't know about his legal status since I'm not familiar with H1B and whether or not your kids just follow you with this visa. But I tend to think it doesn't matter because an LPR is eligible to file for an unmarried son of any age.

but if the person here is illegally, even if the parent or spouse is a citizen they can't even file. but not looking at it, i believe the son is here legally. if so, she coudl put in for him.

Whatever you do, do it before the 20 year old turns 21. And also the fact you were H1B is irrelevant.

In her case, being an LPR his age doesn't matter at all as long as he's not married.

As an LPR she can file for unmarried sons and daughters of any age - category 2

If a USC files it makes a difference because umarried childs 21 and older fall under category 1 whereas unmarried kids under 21 are considered immediate relatives who wouldn't have to wait for a visa number.
