***help Me Please...***

Hello!I just want to ask regarding the filing of EAD and how long does it take in VSC? Im under I-130(Petition for Alien Relative) and I filed mine in VSC and my lawyer already got the receipt (small, thin yellow slip) last July,18,2002 (this was the date marked on the receipt). And until now October 27,2002, me and my lawyer haven't heard from the INS. My lawyer told me to go down the INS and ask for the EAD but say there are no guarantees that they can issue it (50-50 chances). What do you think should I do? They might denied me if I go to INS would they? Im so confused and depressed. I hope someone could respond.Please, please,please!! Thanks!

Well, before I give you my advice on this, let me tell you my story first:

My lawyer filed the EAD for my wife and me on the same day to VSC...I got my EAD in less than 2 weeks...However, we did not get any response back for my wife's EAD one and half month since the date both our application were filed. I raised my concerns to my lawyer and she called to VSC for me and found out that: THE CLERK who handles my wife's EAD file MISPLACED my wife's EAD file and thus we have never heard any thing back on my wife's EAD application...My lawyer told to INS @VSC and my wife's EAD is now being processed and NO, we have not received her EAD card yet although we both filed on the same day in mid August and I received my in the begining of September...

so, I hope you are not unfortunate as we are, but you might want to check out with them....

I think what your lawyer said about 50-50 chances holds true. However, since 90-days have passed since filing for EAD, you may get it at local INS center. I'm not very familiar with I-130(Petition for Alien Relative) types of cases, but I don't think they will deny you just for showing up, especially after 90 days. but instead may ask you to hold on for some more time. not very sure....
