Hello I'm very happy to have found this amazing resource. I have found answers to many of my questions but I still have some uncleared ones. I'll explain my situation. I recently got married and the marriage license should be in the mail by tomorrow. I'm ready to start the process but I still have questions of all the forms i need to send. I came to this country when I was 12 (now 18) with my family with an R Class R2. The visa was given for 3 years but I overstayed. Do you think its necessary to pay a lawyer to do all the paperwork or I can do it myself?

Are these all the forms I need ?

i130 - along with G-325a for both my wife and Me
i-485 - Green Card
i765 - Employment Form
i-864 - Sponsor Form
i-131- Travel Document ? is this only If the person is outside the U.S ??

I'm sorry for all the questions I just want to make everything right wouldnt hurt asking.

Thanks

EinerMart

Did you marry a US citizen?

You already got the marriage license before getting married. The marriage certificate is what will be delivered to you later.

The I-131 form is used to apply for Advance Parole, which is for applicants who want to travel outside the US while the I-485 is pending. But even if it's approved, you won't be able to use it if you have overstayed for 180 days (or more) past your 18th birthday. So don't bother applying for it unless you are younger than 18 years + 180 days.

You left out the I-693 medical. You need to make an appointment (actually 2 appointments -- one long appointment, plus a shorter follow-up a few days later) with a designated civil surgeon to take care of it.

Thank You so much for all the helpful info.

Yeah She is an American Citizen.

Don't I have to wait for Immigration to tell me when to do it ??

Also When I send the i-130 do i wait to send the 1-485 or I send all the forms in one whole package ?

Thanks

Just send all the forms in one package. As Jackolantern said, it is pointless for you to apply the I-131 because you cannot use it. You have overstayed by more than 180 days and if you leave the country before you receive the GC, you will be barred from entry.

You need to do the medical(I-693), otherwise you will receive a request for evidence(RFE) which will slow down the processing of your case. The forms that you need to file are I-130, I-485, I-765, G-325A x2, I-864 and I-693.
Hope that helps

You can do all the paperwork alone unless you have extra money to throw at a lawyer. My rule of thumb is use a lawyer if you have a complicated case

You mean I have to do the medical before I send the forms if so Where Do I schedule an appointment for that ? Any Clinic?

No, you're supposed to send it with the I-485.

Schedule an appointment with a designated civil surgeon in your area: https://egov.uscis.gov/crisgwi/go?action=offices.type&OfficeLocator.office_type=CIV

Bring your immunization records to the appointment, so you can avoid some or all of the vaccinations (although you may get booster shots for one or two that you've done already, if your last shots for them were when you were a baby).

Thanks so much Jackolantern ! Do i have to bring the form I-485 with me to the appointment or does the surgeon have it ?

No, you only fill in certain sections of the I-693 (name, address, etc.) and bring it to the appointment, not the I-485. After the exam and test results the doctor will fill in the rest of the I-693 and mail it to you in a double-envelope. The outer envelope will have your name and address and you can open that, the inner envelope will be sealed and you should submit it sealed with your I-485.

Great Jack ! I'm making some progress now thanks to you. Sorry for so many questions. I'll update my progress

Thanks again
