Hi, Everyone, I am scheduled AOS interview on March, 4,04.
Finally came after long times (3 or 4 more years waiting..)
I need someone's advice. I have been marry my wife who is AMC now
since 97. She was permanent resident at the time of
marriage and filed sponsorship. We also had a stoke
interview by INS before (98) because there were
incorrect information on the application. we passed.Everything was ok.
And finally I am schedule 485 interview on march in NYC. Here is my
concern.. Our marriage did nor go smmothly since last
year. I did everything that I could, but unsuccessful.
and she is not cooperative to go to the interview but I'm trying. She said
filed divorcing process without my conscent, but it is
not finalized. I have not received any papers for the
process. What if I can not bring my wife to the interview,
what is going to happen to me??
Can I still get approved because we have been married
almost 6 ~ 7 years, our marriage was not fraud..nor sham..
However I did not receive conditional resident cards.Because when I was young under 21, my father
filed Permanent Residency based on employment sponsorship. However, we were schemed
by the lawyer, and founf out he applied us as Asylum cases. That's another story, but
to make short, that mess has been settle down in 2002. I really want to make this happen
and live my life freely, but I am scared that what is going to happen if I can not
persuade her to go to the interview.. she is not even answering my phone call nor email.
Please advice me...
Thank You....

Do you guys have any children together since you have been together for 6yrs and over? If yes, that proves that you guys entered the marriage in good faith, why else would you have a kid. If no, then I will suggest you gather a lot of proof from friends, your employer, church members ect who can colaborate that you two were trully married. If you can't find any of these then I suggest you find a very good Immig attorney. The ideal thing is, if you want to make your marriage work, seek counseling if your wife is willing. Good luck.

For the AOS interview, both husband and wife have to attend the interview. If for some reason she refuses to go, you are pretty much out of luck...
