Kashmir,

One of my friend and her husband are on H1-B. They applied for employment-based green-card for both. The notice date is June 02.
The primary applicant is the husband and unfortunately,he passed away in a recent car crash.

What happens to the Green-Card for the wife?

Heard that someone you know were in a similar situation. Any pointers or any suggestions in this direction are greatly appreciated.

I am sorry to hear about ur friends loss. Actually, as far as I can remember, routinely/technically, without the primary applicant, the secondary application would stand cancelled. But, if INS is not informed and hopefully, if they have already completed FP, they approval might come through without RFE r second FP. I think, they were trying to get Senators help.

Sorry to hear such a tragedy on your friend.

First, please advise her to keep her H1-B status if she is still on H1-B.

Under the current immigration law, their Green Card applications are not valid any more.
I think the only way for her to get her Green Card based on the current application is a private bill that her Congressperson or Senator should introduce and that must pass through both the House and the Senate, but it looks very hard though I am still working on the above lady's case with Rajiv's help.
