I filed concurrent I-140(OR)/485 on 9/2002 at TSC. Now I have an opportunity to transfer to a different job function within the company. The new position will require most expertise that the I-140 was based on, however, the function will be somewhat different. Current job is materials analysis; and new job will be materials development. Will AC21 apply in this case? Any possible problems? Anybody has had similar situation? Many thanks for your replies!

It shouldn't matter. In fact, I doubt if there is need to use AC21 since you are within the same co.

pb74: Many thanks for your answer to my question (as well as your help to other folks' questions...). My new opportunity will be at a different site - does this matter at all?

Check your LC. It's mentioned on the LC if the job is location specific or not. If the job is not location specific, you can go to different city or even state. Also check with your attorney if this falls under AC21.

as FunnyWait said, you shud check your LC for any geographic limitations. In majority of the cases, there wont be any geographic limitations. If you are with any consulting companies, they wouldn't file your LC with this restriction.

Having said that, I shud also mention that there is no specification of geographic limitation in AC21. Therefore people argue that change of location shud not impact AC21.

But in your case, you need not file AC21 since you are with the same company.

all in all...it seems that you are in good position.
