When you file I-485 you are automatically in a legal status. However, if your I-94 is based on H1, then your H1 also expires. You will then need to either renew H1 or use EAD to continue employment.

If you are in any other visa category (say B2) then expiring I-94 has no effect and you continue to be in a legally valid status.
You will need EAD to work and AP to travel.
