RFE information.
Hi everybody,
I would appreciate any info for the following

MY GC details

VSC EB2 RIR
PD 05/99
I485 ND 02/01/2000.
First time FP done (Both me and my wife) 03/29/01
My wife had to do FP again on 04/25/01.

My first EAD duration 03/2000 - 03/2001.
I never used EAD, I have my H1 valid until 07/2002.
My H1B stamping in the passport was until 01/31/2001.

Applied for EAD renewal in May 2nd week.
New EAD Details are
RD 05/07/2001
ND 06/05/2001. Still waiting for the approval.

My employer is going thru lay offs and asked me to be
on vacation. I have been on paid vacation for the past
4 weeks and I have one week of vacation left.

What are the possible options I have if I get an RFE
requesting for the past 2 months pay stubs in Auguest.

My employer/attorney are suggesting that I can stretch
the vacation until Auguest 1st week. i.e. taking one
day as paid vacation for every week and 4 days as
unpaid vacation. So that I get the pay stubs through
out July.
My question is
1. Is INS going to be happy with such pay stubs having
one day as paid day for every week ?

or

2. Can I go to India on Loss of pay and come back
after I get my RFE or approval and use the last week
of the vacation. But my H1b stamping in the passport
has expired in Jan 2001. Is this going to cause a
problem if I go to India.

I would greatly appreciate for any suggestions or information.

Hi I think your case may be approved soon. Wait. Even if laid off, you are protected by 180 day rule. Keep a stand by job with similar capacity.

Nothing to worry, you have the option of filing I-485 if you are already in the US. However, doing consular processing is much faster. Check http://www.immihelp.com for deatils on Consular Processing.

Good Luck!

But how could he work, if he does not have an approved EAD ?
