Here is my situation, I have an approved I-140 from a former employer (was laid off before filing I-485). The old PD is 3/2001. My current labor was approved last month after 2 years of waiting (w/ PD of 1/2004, thank GOD!). Have read from somewhere that one can retain the old PD if the I-140 was approved. Has anybody really done that? If the answer is yes, what kind of evidence should I provide? Can I do concurrent filing? Many thanks...

Ask your attorney to refer this.. more and more people are considering this option with retrogression in effect.

Link old I-485 to new I-140
Can i link a pending I-485 to the newly approved I-140?
Here is my sutuation:
1) EB3 I-140/I-485/EAD/AP concurrently applied(pd may 2001).EAD/AP approved in 2004. The I-140( and I-485 denied) for a2p.
2) MTR applied- I-290B for I-140 and I-290A for I-485.I-140 Pending with AAO.
3)Now got a new EB3 I-140(pd dec 2001) approved with new employer.
Is it possible to attach/interfile the old I-485 to the newly approved I-140?
Will this revive the old EAD/AP and can it be renewed?
