Help!! How to respond this RFE

I got an RFE asking me to submit the tax return. However, since I have been in the US for less than 3 years, the treaty between the US and my country allows me to be exempt from tax.

I therefore do not receive any document or tax return, though I have to file the tax forms and send them to IRS each year.

My question is: how to respond this RFE? Experts please advise.... Please

The 'tax return' is basically the form(s) you sent to IRS each year. Attach a print out of the law that allows you to claim the tax exempt. You can find it from the IRS web site.
 
Only the forms I sent to IRS each year?

Are these forms the so called "tax return"? I thought they were something your received from IRS. Can you or any other shed more light....

You need copies of forms called "1040" that you fill out each year and mail to IRS.
 
I had similar RFE and talking to my lawyer, he mentioned that INS is only interested in the W2's.... So, I would suggest check with your lawyer and he might be able to shed more light.

I think if you have W2's you are good.

For some reasons, if you do not have photo copies of your 1040s, you should be able to get tax-transcripts by walking-in to your local IRS office. Transcripts should suffice INS requirement (Pl. check with your lawyer). IRS charges about $25 for each year to provide you actual photo copies of your 1040s. (Please check IRS website for actual amounts).

Am I correct to send the following for this RFE

Thank you all so much for your invaluable inputs. Now I intend to submit the following to INS for this RFE:

1) W-2 form;

2) 1042s form (which each year I receive from my college, together with W-2);

3) The tax forms I filled up each year that I sent to IRS.

Now are they okay?

Dear Frank,

Every year I got a W-2 and 1042s from my college. I file 1040 tax form and 213 form to IRS.

Now, is the "tax return" simply meaning the above documents?? Guys please make me clear....
 
tax return means form 1040, or 1040Z, 1040A, ect. their full name is "US individual Tax Return", or simply names it "tax return"
