Hi Friends,

I have an issue here, I am a canadian Landed immigrant, entered into USA on H1B.I have shown the I-797 by the time i entered USA, the Immigration officer at the Niagara border post has issued only a I-94 on jan 9th 2003, but he didn't stamped the H1B visa and my visa was valid till June 2003 with my previous employer.After i entered USA within a week I got a job so my new Employer has filed the H1 at Texas service center, and i got it on Mar 06th.

I have send all the necessary documents to my wife to get her H4, at Chennai American Consulate General, they are telling that i am staying in USA illegally, i was shocked how come i am illegal, having a legal and valid I-797 and I-94 up to 2006.Only thing i don't have till now is H1B stamping in my passport.

I send all the supporting documents again to American Consulate general, Chennai proving my legal status, second time also they come out with the same answer.

I think i need to stamp my H1B going back to canada.In the mean time i need your help if any one have come across this kind of case, please help me out from this problem

Get an H1B Visa stamped from canada and you will be fine . The problem here is that You do not have a visa stamped on your passport .
