HELP HELP HELP - H1 and EAD Issues

Hi Rajiv,

Rajiv, Here is my question.

Iam working in US on H1 B right from June 2000 and it's going to expire on June 2006. 2 more yrs to go on but still haven't filed for GC and that means no EAD. Recently got married and my wife a filed for H1. I may fall in either of these 2 options below.

a. If she get a job then how quick she can file for GC.? Normally what is the time period to file.? Or if she couldn't able to get the EAD within my 2 yrs time , what will be the position for both of us.?

b. If my wife gets EAD, can I stay here in US after the 6th Year.? Since being the dependent, will position be subject to change based on her status.?
Can she extend EAD so that I can able to stay for 7th year?

It will be really great if you guide me in this regard.

I-485 Issue

Hello everybody,

I am a new member over here. I like to see people are communicating in such a great manner. I have a question, I would like to know the answer.

In fact, I wanted to go to my country in a short visit. In the mean while my lawyer is ready to apply I-485/140 along with EAD and Advanced Parol (AP). He denied me to leave the country as her argument is that when I-485 is being filed ALTHOUGH MY H1-B VISA IS VALID TILL MID-NEXT YEAR i.e. 2005, then somebody has to have approved Advanced Parol (AP) before leaving USA, otherwise entry into USA will be difficult. Thus I am just thinking if I should go ahead with the filing or I should request my lawyer to do so after I will get back from India using my present valid H1B visa. Please advice. Again I will be applying from CA center which is the one of the slowest among others. Please let me know as soon as possible.
