My son will turn 21 years old on Mar 2005, his H4 visa will also expire on this date. My labor certification for changing status for the whole family to permanent residency is still in the US Dept of Labor. At the rate the processing times is going, I'm afraid we won't be able to get our EAD before Mar2005. Can anybody please tell me what are the options we have, so he can continue his stay here. I wouldn't want to send him back all by himself because he will have nobody there. For my wife and myself, there's no problem because our visas is until Nov2006.
I have to be prepared for the eventuality, so I would highly appreciate whatever advise anybody can give me.
