Hello,
My H1B is due for first extension (after the first 3 yrs, current H1B ends 03 Dec 2009) with same employer. I work for State Health Department asked to prepare documents to apply for H1-B extension. I self petitioned my H1-B because my HR is not familiar with the H1-B process. It will be greatly helpful if you guys can help me out...
Here are some questions, please help me.
1. Do I need to (employer will pay) file everything over again (LCA + I-129) and pay all the filing fees?
2. Can I concurrently file H4 dependent (I-539) extension also with I-129?
3. I have about 4 months that I traveled/vacationed (30 days paid rest vacation) out of US. Is there any possibility to recapture those time (4 months) with the current extension application?
4. I have three full months.. Should I go for Premium processing or do regular processing?
5. What if I decide to do regular processing and approval doesn't come in time before I-94 expiry date or I-129 dates (03 Dec 2009)?
