Help! --H-1B over six 6 yr. extension-485 filing

hi guys,
a friend of mine is about to file 485.
his H-1B six years are getting over in a couple of months.
he can use AC21 to apply for 1 year extension and remain on H-1 while 485 is pending
however, company is saying that to file H-1B extension, they need to advertise his position for
10 days and since there is a hiring freeze at his company, they cannot do so..he is trying to work
out this with lawyer, his HR dept.
anyone in the same situation?
any suggestion will be appreciated

his 485 will be filed only in feb first week and his H1-B is ending on Apr. 30.
so he cannot complete even 90 days before his H-1 expires.
 
I don\'t think it has to be a newspaper ad

For H1s, mostly it\'s an ad you have to put up in your company notice board. If you\'ve good relationship with the employer, they can still do it unless other employees don\'t make a big issue out of it.
 
How can I start my H1-B after I complete the fist 6 years?

The INS rejected my I-140 because of the financial statements of the company. We filled for a Motion to reconsider but are still waiting for the reply. My H1-B total six years are going to expire and I would like to know how to extend my H1-B.
