I recived a packet from USCIS chicago and it has the check that was sent and the packet with a I-797C notice of action that states
NOTICE TYPE: Rejection Notice
The application/pention you filed along with any fee you submitted is being returned to you for the following reasons:
This BCIS location can only process I-130 applications that are submitted with the form I-485 when a visa number is immediately available for the beneficiary's immigration category. Please file your form I-130 at the BCIS service center with jurisdiction over your place of residence.
I am confused as to what or why this happened my lawyer sent all this in w/my I-485 and 765 and the I-130 all to the chicago office and the I-130 was sent back with the above notice..Any ideas?? My lawyer is in germany till thursday so any advice woul be helpful we live in Montana
