Hello,

This is my situation. I am getting married next week to a US citizen, I have lived n the US for 9 yrs now, she will be petitioning for me and I want to know how long will it take for me to get a work permit? I live in California.

I was married in 1996 with a US citizen and she applied for me back then, unfortunately marriage lasted 15 days only and got annuled. The annulment was caused and filed under irreconciliable differences.

My question is: will my past "annuled" marriage be a problem with my new one in filing with INS?

What are the issues that may arise during my new application for a GC through my new marriage having an annulment on record?
I already have a job offer with a great company, I am suppose to start working on Nov 26 but I don't have my work permit. Once I get married I will have one but any advice about what to do to expedite work permit ? What should/can I do to be able to start on my new job in case I don't get my work permit on time?

Advice?

What is your present immigration status??

A work permit issuance varies from every district office. You can get it in 1 day or in 90 days.

What was the outcome of your past INS application?? Was it withdrawn / denied??
Spouses of US Citizens are generally pardoned for an illegal stay or illegal work in the US as far as they donot have a criminal conviction.

With your past annuled marriage You and your spouse will have to prove to INS that the marriage is for the right reasons and not to obtain a green card.

If you donot have a valid work authorization you should not seek employment.

Hope this helps and feel free to ask any more questions.

Hi,

Thank you for your info.

Ok, when my marriage was annulled my mom who is a US citizen applied for me. So, I already received my approval for that application but my priority date is not up yet. My priority date is in Oct 95 but the current one for my category is Oct 92.

So, by getting married with my fiance we think it will be faster to process my documents but we don't know what other problems we may face.
What do you recommend me? to wait for my priority date to catch on or to get documentation through my marriage?

Will it be faster through my marriage?

thank you for your help.

Let me know.

Hi

I would say use the married option only because it can be faster but again you have the risk of the marriage not working which can be problamatic.

I would suggest that you consider that option but also talk to an immigration attorney.. If you know know of one let me know I can recommend one :)

take care and all the best.
