I mentioned here my details and tell me whether I have option to file Consular Processing or what else I do.
- I came with my family in September, 1994
- I started my green card on October, 1997 (Non-RIR)
- My labor got approved on June, 1999 (EB-3)
- Filed my I-140 on July, 1999
- Decided to go back in India in June 2000, since my 6 years in getting over in Sept 2000,
- Send my family in August, 2000 so that I can finish the remaining work and go in Sept 2000.
- Since I had hope in the New Law I applied for H1B extension for 2 months (Vacation) in Sept 2000.
- Since the new law passed, my company applied for extension for 7th year in Nov 2000.
- But till today I haven\'t got approved both my extension.
- In the meantime time my I-140 got approved and it say that I can do CP in India a
- And also my PD become current in Apr 01, 2001.
Since I can\'t add my family in I485 because they are in India and I don\'t whether I can file CP because of my both the H1B not got approved.
In this situation what can I do?
