Help for EB1-B RFE!

Hi, my I140 got RFE after PP.

I have a couple of questions for the RFE.

1) Provide evidence the beneficiary has reviewed a sufficient number of manuscripts to demonstrate the beneficiary's international recongnition as an expert in the field.

I have reviewed 10 articles from 5 different jounerals and one grant from Europe, but it said I only reviewed 3. It seems the officer didn't read my material carefully. What should I do, should I send all the supporting document again?

2) The same as above, provide evidence for citation.

I have more than 50 citations, but it seems the officer didn't get them either. I had sent a list of the citations and the first page of them. Should I send all the citations again? Also should I add the pages where my papers are cited? I gave all of them to the lawyer, but she said that was too much and she only used the list and the first page.

3) I am a faculty now, before that I have 2 year postdoctoral experience. In my petition, I used my Ph.D study as one year experience, but the RFE said in my Ph.D, I was working on my degree. How should I respond to it? Anyone can give some suggestions.

Help for EB1?

Which service center did you apply to? Did you use a lawyer, at least one should have been provided by your university?

I am not sure if there is a category called EB1-B. Are you referring to EB1- Outstanding Researcher/Professor?

Please do not panic, there are cases (quite a lot actually) when I140 is applied through PP: usually gets a RFE. There is quite a bit of discussion on this topic. Was yours at NSC or TSC?

Most likely, you'll have to re-submit the materials and maybe some additional ones too. Make sure you address all the issues point-by-point.

YES, definitely add the page where your paper has been cited (I cannot stress its importance). This is the only place where the officer gets an idea of how important your work has been. Make sure that articles which discuss at length your work are on top. Articles which merely cite you (as another method, etc) should be at the bottom.

The officer is not going to go through all your material, so make sure that the few pages he glances COUNTS!

Regarding this RFE, its not something to worry about too much. I understand its easy for me to say but quite bothersome for you. But this is supposedly the norm for PP cases so ....

Thank you all.

Yes, it is Outstanding Researcher/Professor. I do have somebody from the university to help me. But she is too busy and will be on vacation soon and I really hope I can have the materials done Asap.


My case is in TSC which supposed to be easy. But I am unlucky.

Good luck to you, dancing fire. The attorney representing you is very very important, especially for EB1-B. Hope you will answer all the questions to the point and precisely. TSC is pretty easy to get approved, but it seems that the officer who looked at your case probably was having a bad day! But, good luck anyway...
