*HELP* Filing Labor thru PERM
Guys,
We are planning to file for Labor thru PERM. Wanted to know how I can effective come under EB2 without much scrutiny. So my question is "How can we prove through extensive documentation that my position as a Sr. Software Engineer can only be properly performed by an individual with a Masters degree with relevant experience as opposed to an individual with only a bachelor's
degree? Can we prove a business necessity? If business necessity how?"
Since we cannot say that having a Masters degree is merely an employer's preference. We would like to prove that an individual with a Masters degree and relevant experience can perform the minimum requirements of the position of Sr. Software Engineer is truly in fact, an industry standard.
Brief background: Indian citizen, with two Masters degree, one from India and one here in US. Both related to Computer science. Work experience of 3.5 years. Currently on H1B visa with a Telecom company.
