Help-fiance Possibly Being Deported!!!

I am a US citizen who has been living with my boyfriend, now fiance for over 4years. My boyfriend, who has lived in the US for 10+ years now, received an approval pending from immigration and immigration needed to do a background check. This case was a political asylum case. Immigration never returned the verdict until requested for 2 years later. The verdict was to refer the case back to the judge, which should not have happened. The case was returned to the judge and the case was found fradulent. He appealed the case and won the appeal stating that the case was true. Unfortunately the case went back to the judge. At the hearing, the judge still kept firm on her decision and now the next hearing date is set for February 2008 which may result in deportation. If that does happen, can he appeal the case again?

Now just some background stuff: he has lived in the US for 10+ years now, is a great guy, no criminal records, has a son here which is a US citizen, has gone to schooling here, worked, and paid taxes. Though we plan on marrying next year, is there anything that I could do to not make this happen or that would help his case? If by chance deportation does happen and he is given a choice for "voluntary departure" should he take that choice? Should we move up our timeline to get married before he gets deported?

Any advice would be helpful!!!!!!!!!!!!
 
why don't you just marry and apply for a spouse, instead of wasting time and money on lawyers and courts? Why wait so long, what will happen next year? Why not now? Are you testing him, or what? Why is it so important for you that he will worn his case first, and marry only afterwards?
 
I agreed with the first post. If YOU REALLY LOVE HIM AND WANT TO HELP HIM marry him NOW and file the immigration paperwork.

If his asylum case wa really fraudulent it will be very hard, not to say impossible for him to avoid deportation.

HE NEEDS A LAWYER ASAP, if he doesnt have one by now.

If you marry him and file for him, it will still be hard to get his immigration petition based on marriage, since he has a "fraudulent" asylum case being investigated.
