Hi everyone!
I am in desperate need of help. I am currently approved for a I-130 petition, priority F-1 (son of a US citizen, single, no children) and currently in the US with a H1-B visa. My priority date is May 30th, 2000. As time of writing, the cut-off date for my priority is April 8th, 2000. I am getting married to a foreign person on December 19th, 2003. I have all the documentation required for adjustment of status (I-485) and I plan to file those papers as soon as my priority date is reached. Thing is, I read somewhere that I can't apply for follow-to-join benefits for my wife, since my priority WOULD CHANGE AUTOMATICALLY from F-1 to F-3 and I would be commiting fraud by getting married while my I-485 approval is pending. Is this true? Does anybody know what can I do to bring my wife to the US? The H4 is an option, but my employer is likely to go out of business soon and the GC would really help me getting another job!
