Help !!! Entering the US with criminal record.

I'm a Canadian citizen that has been in the USA for 9 months with a criminal record in Canada from nine years ago. I have been denied before, but in the last two years have flown in and out without ANY hassle. I would like to remain in the US for another year. Why do the customs not bring up my record when they scan my passport ?

I also have dual citizenship with a French Passport. Can I use that instead to get a visa or green card to avoid the background check ?

If so must I provide a return ticket ?
