HELP!!!! EAD expires this month 26th

- We filled our I-485 in Nov-2001.
- Went for an interview this year in Jun and they told us that we are all set and they are just waiting for our FBI clearance.
- After some time we received a notice that my wife's fingerprints got expired and she gave her finger prints two months back.


Our EAD expires this month 26th.. We filled for an extension in September. I just checked the status of EAD the application on INS website. It says that the case has been transfered to the Local Office.

Can I work after my EAD expires because my receipt says that it takes 80 days to process this kind of applications. And our EAD expires after the 60 days.

Would it help if I go to the Local Office, Would they entertain us visiting the Local Office in Dallas?
 
I am in a similar situation with you. I have two I-485s pennding (employment and lottery DV). I applied for 2nd EAD July 8 and it has not yet been approved. My EAD expired in this month.
My case has been transfered to a local office waiting for CIA and FBI clearance.

according to my understanding, you can continue working as long as you filed the renewal application before your current EAD expires, INS doesn't have a problem with this.
You have to be only concerned if your employer asks/demands a valid EAD at all times.
Hopefully the new EAD start date will be the expiration date of the old one, so once you get the card you will be ok.

I am planing to visit the Local Office and explain them the situation. I heard that they are sometimes understanding. My attorney also suggested me to file for a inquiry on your adjustment of status application at the Local Office.

Did anyone do this before?

I Totally disagree.

As per the rule you should have a valid work permit at all times while you are working. Yes it should be fine if you employer does not trouble you and CIS does not catch you working without a permit. It is not always true that the renewal EAD's start date will be from the previous EAD's expiry date. So why take chances, try with yor local office.
 
Recieved a reply from my Attorney.

He strongly recomends me to make a visit to the Local Office . But he has not told me any specific office..

Does anyone any know the main office in Dallas?
 
Local Office

My attornet told me to go to the main Local office and they will give me the card since the case has been transfered from the NSC to TSC.

He says if we filled directly with TSC then they migh not consider my request.

Any one sailing in the same boat or experienced this before.
