I have GC interview scheduled for this Tuesday. I am married to LPR. I have got EAD approved last month(valid for 1 year) and my priority date is Jan 2003.

With PD being retrogressed all the back to 1999, I am guessing even after the interview, I will not getting the plastci GC card just yet. I will have to keep renewing my EAD every year and also the Advance Parole. Can I switch jobs with my EAD. Am I free to work for any employer as long as my EAD is valid??

TO the important question. My spouse will complete 5 yrs in March 07 and be eligible to become a US Citizen. Will that in any way help my cause. IF we apply for citizenship in Jan 07(90 days before) and get the citizenship in 6 months or so(hopefully), do I need to reapply under her citizenship. What do I need to do?

Will my going to the interview this Tuesday, restrict me from filing under my spouse's citizenship?? Please help... :(

Thanks for all the help.

I am a little confuse about your post...

1. Are you doing Adjustment of Status? If the answer is yes, then I don't understand the first part. The GC interview, is THE interview, that's it. You get approved or denied. I never heard that a person received the interview letter if the priority date is not current, actually a person cannot do AOS if their current dates and visa number is available.

For the citizenship question...that your spouse wish to apply for citizenship has nothing to do with you. Your spouse is the one that can apply for citizenship, that's it. You only can apply for citizenship after you have been a LPR for 5 years and meet the rest of the requierements.

Please clarify,

Sorry for the confusion.

I got a letter in response to my I-485 application to go the Newark office for the interview. The letter says "interview" on it and I am assuming this is the GC interview.

As for my spouse's citizenship, yes, I know only my spouse can apply for me. What I wanted to know is what do I have to do after she gets her citizenship. Do I have to start applying I-130 again to get the GC

I think you have a huge confusion about the process.

If you applied for I-485 based in your marriaged and now you get your interview letter, and the interview is for your I-485? then THAT is the GC interview means that in the interview you will know if you are approved (will received the card on the mail) or denied.

Again, you have nothing to do with your spouse citizenship. Why you will have to start all the process again? if you are ON the process already?

Let's recap some of your story and see if this all make sense...
1. Your wife applied for you the I-130? in 2003?
2. When your priority date become current?
3. When you apply for your I-485?

1. Yes. Actually my bad intially. its 2002 and not 2003.
2. Became current sometime end of last year.
3. Applied for I765/I485 March/Apr 06 (this year). Got I765 approved in mail last month. Also did fingerprinting 5 weeks back.
4. 2 weeks back got letter from INS to appear with spouse in Newark Office on 15th Aug. Bring usual supporting doucments like birth certificates, proof of marriage, joint accounts, joint bills etc etc.

So you are set then. The interview is the final step and that's it. You don't need to do anything else just go prepare with all the documents and your spouse.

If your spouse apply for citizenship you don't have to do anything else. After this interview you will be approved or denied for the US residency.

Now I never understand pretty well, how the visa bulletin works on the dates that they post and looking at the current one they all are on the 90's. Looks that they went back?
