I am in a rock and a hard place. Any comment/answer/suggestion/advice would be appreciated.
Timeline:
1. Original bachelor OPT expired in Oct. 2010.
2. As an insurance, got a new I-20 for master degree in early Dec. 2010, within 60 days of the expiry of 1.
3. H1 wit premium processing was filed in Dec., after the new I-20 was obtained.
4. Started as a full-time master student in Jan. 2010.
4. Received letter of denial a couple of days ago. The letter stated that I am out of status.
Questions:
1. Why am I out of status? Shouldn't the new I-20 give me F-1 even though my H1 was denied?
2. Assuming I am indeed out of status... How long can I stay in the US without ruining my future chance of applying for a US visa?
3. Assuming I am indeed out of status... My kid is a high school senior and is out of status too. Is there some way for the kid to stay for another couple of months to at least finish high school?
