The company A I am working has done some “corporate restructuring” by entering into an asset purchase agreement with comapny B. However, both entities have the same owners and principals. The restructuring was done to facilitate the change of ownership from an S-corporation to an LLC. My previous company A will still be an existing entity, and will have a functioning relationship with B. Company B however, will have principal authority for the ongoing business activities at the site.
My question is:
1. Will this change affect my current H1B? Do I need to file a H1B transfer?
2. If I need to renew my H1B and I file the H1B under the new company B, is this filling considered H1B extention or H1B transfer?
Any of your advice is appreciated.
