Hello,

Desperately need your help. I got my I-140 approved from MA, but just as it was being approved, got transfered to Atlanta GA. Now I come to know that my I-140 that was applied in MA has been approved, approval notice is with the company lawyer.

Can I still apply for I-485 while working in Atlanta?

It is the same job, same company and same everything. Just the change in place.

Has anyone been in this same or similer situation. Thank you very much in advance for all the help.

You have the choice of applying at Texas or at Vermont. If you are still staying at MA apply at Vermont Itself

Request sent to legal.

Thanks guys, you were really big help. Sent a request to the legal asking them if we can go for 485 fileing based on the previous 140 approval. Waiting for a positive reply... Wish me good luck.

Thanks again,

The lawyer now says that since the 140 was approved after I moved to Georgia, it is not valid. So wants me to start the labor process all over again. Please please help...

NOWAY attorney is not correct or delvering/speaking words of someone else mouth (u know what I mean) .

First u are working the same company doesn't matter palce. and even u were not, the company is sponsering u. u got LC+140 approved. rememeber ur GCpetition is future based empl.. nothing to do with ur current job. if can be adjust in this way 'after approval of GC I will be working on that office' :D . (use ur own brain they are making u fool and trying u to stic/trap few more year). u got LC+140 all u need is 180 days time. :D

For ur knowledge 485 can be submitted urself individualy..
here what to do, just get ur 140 approval. quietly submit ur pettiion, stick with same company. till 180 days. then u are free. stick same or change it. at processing time if RFE issued use EVL. or if u changed place/moved max they will transfer ur case thats it... use same/new empl and AC-21 if needed.
don't be stupid to start ur LC+140 again take years.....

If they force u to start over
say 'no prob' . ...... first get ur approved 140+LC.

let them send new LC pettition ..... stick same empl

Use 140(approved one) file 485 urself. and after 180 days u are free man....... :D . all u need 180 after receipt date of 485 thats it. (140 should be valid till 180 days)

still confuse? send pvt msg.

Good Luck

Your lawyer is becoming an @#$%^%..

You should be able to file I-485 using the same I-140 petition..

Here is what a local lawyer says :( - NOT GOOD -

Thank you all for your response and support. I did talk to a local lawyer, and accordingly the company has to provide with documentation stating my current job location is temporary and that I am employed from the MA, where originally the I-140 was approved. Then, once we file the 485, six months down the road they can claim to have made my current location permanent.

Very unlucky for me, the company is not ready for any such stuff. :( :(
