I wanted to ask you something if its ok with you. I am trying to reply to my RFE of employment letter and pay stubs on my own. Could you please tell me when you changed your job after 180 days and when you replied to your RFE, did you also send your previous paystubs or something to INS to prove that you changed your job only after 180 days?

Also, where did you get the format for employment letter to send it to INS from?

Just send whatever they are asking for. Although you need not prove that six months you worked for I-485 sponsoring company your start date in the employment letter from new company and your W2 will prove that point.

I am glad that you are replying your own RFE and saving a bunch of money on lawyers.

My lawyer informed INS abt change of job before I got the RFE, which I beleive a stupid mistake by her and as per me one should not notify them abt change of job.

Regarding my RFE response to INS, they asked me only latest 6 paystubs and last year W2 and that was pretty simple, so I just sent the latest company documentation what they asked for and original RFE notice (this is important, w/o this they wont accept your RFE response).

In your case, you need to send the latest employer paystubs and employment letter and this will be sufficent proof that you changed your job and sent the latest informaiton.

thanks for the response.....but if I just send last year W2 then that will have all the info of my latest company........as I joined it in Oct 2002. I think this will not satisfy them to check when I changed the compnay, right? Then they might send another RFE to check my status in first 180 days of I485 i.e. from march to august 2002. Is there anything I can do to prevent my next RFE?

If I send my 2002 W2, then it will clearly show that I lost job in <180 days. Do you think I should take a very competent lawyer....because it all looks screwed up to me.

Once again, INS just want to know the current status of yours, whether you are employed or not as they are giving you employment based permenant residency, so dont worry, send the latest company information and YOU WILL BE OK. Many ppl has appoved this way and INS cannot deny your case just because you left your job before 180 days. Your case would be problematic if your case was adjucticated within 180 days after filing 485.

INS will be satisfy with all your latest documents for sure and you have no other option but to send current documents. You cannot produce previous company employment letter nor the paystubs, do you?

INS does not sends two RFE's to same applicant unless and until they hv misplaced your response( like mine), so be +ve and you will be thru with your case.

Did they ask you abt 2002 W2? Just send them what they asked in your notice?

Based on this one can change employer before 180 days of I485 but should pray that your I485 will not be approved before 180 days.

Since you have passed more than 180 days since your I485 was filed, I think you are fine.

Also the 180 days always starts since when the I-485 is received by the BCIS irrespective of whether it is filed concurrently with I140 or after I140 is approved.

The key point to be noted is that the one should change employer only after I140 is approved.They can change employer before 180 days of I485 hoping that I1485 will not be approved before 180 days or change employer after 180 days on I485 if they want to be safe.

Also if the I-140 is withdrawn by the old employer on or after the 180 days on I1485 and the employee has not submitted evidence of a new employment to the USCIS, then USCIS may issue a Notice of Intent to Deny (NOID). If the applicant answers the NOID by submitting evidence of a new offer of employment which is similar to the old Employment then the I-140 will remain valid and the I-485 will be processed normally.

Once you apply for I-485 your status is pending AOS. You need not worry about the status. Pending AOS is status which is independent of the your current job.

My suggestion would be do not try to prove any extra things. Just reply what is required.
