Hello, guys. This forum is a great place to learn, clarify and get soothed that we are not alone in the struggle. I am post doc in J1, doing ground work for my waiver and GC-EB1-2. I will be competing my 3rd year J1 in Aug'06 and I understand that at that time the SEVIS will be implementing the extension of J1 from 3 to 5 years. I plan to get my extension at that time (bit too close and risky) and later proceed with waiver and subsequently GC.
I have 3 questions:
1) Is my time frame too close or speculative - J1 3 yr and 5year extension?
2) If so any suggestions like an alternate plan or visa status change?
3) Is it possible to proceed with EB1-2 filing without waiver?

Anything can happen at anytime wrt J1 extension. It will difficult for anyone to suggest anything related to you obtaining a waiver. If you are confident that you can get waiver in 6 months try getting 6 months extension after 3 years and wait till they announce actual extension.

For filling Eb1 you need to have permanent job(eb1OR)............ for Eb1-EA i guess H1 (working VISA) is sort of unofficial (or official I am not sure) prerequisite. BCIS often tends to think that J1 guys are temporary visiting people... And thus wavier automatically becomes prerequisite for Eb1
 
6 months extension after 3 yrs?

How is it possible to get 6 months extension with the J1 being valid only for a 3 years max?

Well, One of my friend did took that extension and stayed for full 3.5 years. He got his NORI letters from home country but didn't apply to State department for wavier...as once u get that you can't get extension!!!
