Having a valid H1 stamped...BUT

I am having H1 stamped until Feb1,2002. I am on bench and have no pay stubs or current employer letter. I have some urgent issue which I have to attend in India. How risky is my travel. I want to come on Jan 12 or Jan 16. Can Anybody help me hear.

If your VISA is valid till Feb 2002 and you return before that then it might not ba a problem as you do not have to show the pay stub for any process while entering into the country.
 
H1 Receipt and notification

Hi Everybody.....

I just joined the board today and my case is that I have applied for a change of status from my old employer on the West coast (CA) to new employer on the east coast (CT). My appln was received by the INS on 19th Nov 2001 so far i have not received the receipt from INS usually it takes about 2-3 weeks to get the receipt but in my case it has been over 3 weeks. Also I have started working for my new employer from 10th Dec 2001 but have not yet resigned from my old company. The reason for not resigning is to have a back door open in case INS refuses my H1 transfer. Am sure there must be somebody who has gone thru a similar situation. Following are my questions and concerns

1. How much long would it take to get INS receipt and the H1 visa transfer Notification ?
2. Should i resign from my old co or play along to buy time till i get the transfer notification?
3. Can my old employer create any problems that might affect my visa transfer.

Any advice on this matter will be highly appreciated
