Haven't gotten my EAD card for more that a year..HELP

I want to ask for any advice regarding my EAD card that I haven't gotten for more than a year now. I am really confused and need anyone's point of view.

2007 my employer filed an immigrant petition (EB3) and the EAD was filed on the same time. October 2007 I got the notice that the EAD was approved. I waited for the card till January 2008 but my employer told me that they haven't received anything yet (the card is addressed to my employer's lawyer). They didn't get the card. My employer called USCIS and insist that they don't have it, but the USCIS is firm that they have sent it.

Rather than arguing with the immigration, my employer filed another EAD card. The notice was approved and sent June 2008 with a validity of October 2008-October 2009 (bec my first card is valid from Oct 2007-Oct 2008). I waited again for the card, but nothing came up. Around September my employer filed a replacement EAD..but unfortunately the immigration sent back the money and the application because my case is still open (that is according to my employer). I am waiting since June this year until now. I'm not sure if I'm waiting for something or nothing..

Honestly I don't know if the immigration has just been slow in my card or is the card already with my employer and he was just holding it due to some reasons. Is it possible that the USCIS will have the same mistake..twice? And I can't resist to think also that my employer is holding it.

Another lawyer told me to file a replacement on my own and with my own address, without telling my employer.

My question is..is it really safe to file a replacement EAD on my own or do I need to get a lawyer?
How long do I need to wait for the card after it has been approved?

You must be having I485 receipt copy from your lawyer. Lawyer must give you your I485 receipt copy. EAD card is sent to the your home address. Lawyer must have put your home address in EAD application. You can even file EAD on your own using I485 receipt copy + otehr documents mention in the application.
 
I have a copy of my I 485 receipt. I don't know why they didn't address the card on me. So probably I'll just apply on my own then. Thank you
