Have You Ever Been Refused a U.S. Visa?

Hi There,

I recently faced a problem while transferring my H1 petition from Company A to Company B there was RFE raised in Company B, hence once i came to know about RFE i transferred my petition to Company C which got approved and It also has I-94 valid till 2007. Now suppose if i visit my home country and in form DS156 there is following question.

Have You Ever Been Refused a U.S. Visa?

What should i answer.

sometime back i had a conversatin with one of the consulate rep while booking appointment at canada and filling out the form, i had the same question and the rep replied that although a rquest for further evidence under 214 or 221g had been issued, since finally the visa was issued/approved, one wouldnot need to write that it was denied.since denied means it was permanently denied, but since the officer asked for further info which later made the visa get issued, then it is not a denial. i could be wrong/misinformed, so kindly ask your attorney to clarify.

Company B which had RFE on my visa has applead and presently the case is with AAO, but i successfully transferred my Company B visa to Company C and presently i work for Company C. Will i need to mention about the RFE was issued or i can ignore it and answer No my visa is never been denied.

Visa is issued by a US consulate in a foreign country. If you have ever applied for a US visa and were denied, state so. Change of employers in US has nothing to do with this question.
